This Agreement is entered into for Introducing a new platform services called “Cinering” and to create service relationship between the Company and Customer
The Cinering is a software platform an Application developed for maintaining business relation between Company and Customer
DEFINITIONS OF TERMS:"Cinering" means a digital platform an application designed for providing various services like ticket booking and getting assured redeeming points from various optional outlets and also includes scheduling of movie of the customer choice
"Company" means K SERA SERA CINELINES AND MINIPLEX PVT. LIMITED, a company incorporated in India and governed under the Companies Act, 2013, having its registered office at 101A/102, 1st Floor, Morya Landmark II, Plot B-17, Andheri- (West), Mumbai-400053, Maharashtra, India hereinafter referred to as "KSSCMPL" (which expression shall, unless repugnant to the context or meaning thereof, be deemed to include its successors and permitted assigns)
"Theatre" shall mean any and all (existing and future) Cinema Theatres owned, operated, managed or controlled by the KSSCMPL directly or indirectly through itself or with any person (including by way of joint venture or partnership) and operating under the branch “KSS Cinema/K Sera Sera” or any other future trademark. The theatres (including their location and capacity) existing and operational as on the date of signing is mentioned in schedule of the Agreement.
"Ticket Price" shall mean the sale price of ticket including Food and beverages, actual Ticket Price and Convenience Fee to be charged by the Cinering for providing services.
"Future Trademarks" shall mean any trade name, trademark or brand other than the existing KSS brand name under which the KSS Cinemas are operated
"Advertisement" "Promotion" means any audio or visual publicity, representation or pronouncement made by means of any light, sound, smoke, gas, print, electronic media, internet or website and includes through any notice, circular, label, wrapper, invoice or other documents;
"Customer" means /members or entity of “Cinering” receiving entertainment opportunities by purchasing tickets or by buying food in order to have a leisure experience; Consumer means a person or entity who downloads the application and enroll for its services;
"Content" means legal content comprising feature film content, advertisement content or any other alternative content that may be for educational, vocational, sports or entertainment purposes through various third-party vendors & third-party intellectual property subject to availability of the content;
NOW,THEREFORE,IN VIEW OF THE ABOVE AND INCONSIDERATION OF THE MUTUAL COVENANTS AND CONDITIONS HERE IN SET FORTH, BOTH PARTIES HERE BY AGREE AS FOLLOWS: -
BUSINESS PROPOSALCinering has come with a new business concept of Application to be downloaded by the customer. On downloading the application customer need to enroll by providing few details which will be basic requirement as to his name, Favourite hero, Favourite upcoming movies and other detail for the data use of the company which will be safe and no misuse of any kind will be assured and will purely used for record purpose.
On downloading the Application and on filling the form a login page will be seen with various options and choices. The customer will have to make a payment of Rs. 250/- ( Rupees Two Hundred and Fifty Only) plus taxes if any applicable in per ticket and book his slot for any movie to be viewed by him in next six month time frame.
On booking a slot and making payment the customer will be immediately redeemed with same number of points into his account which he can use as discount for the purchase to be made by him in the shops as provided in the list located in his locality related to eatery, Clothing, Medical or other necessaries.
On redeem of point will go into the account of the shopkeeper who can utilise the points for buying slot of advertising during the beginning or during interval of the shows of the movies depending upon the point list to be mentioned in the schedule.
The Shopkeeper can also buy advertising slot by our various packages and choice available for him to make selection according to payment criteria as mentioned in the schedule
The Cinering will help the customer book ticket of his choice and book the slot with the Theatre owner according to the availability of location and seats of his choice.
Cinering will provide free popcorn and cold drink to the customer as a complimentary for using the application for booking tickets and availing our services.
Cinering will pay the Theatre ticket price as consented between both the Parties.
Cinering will provide advertising slides to the theatre which will be played by the theatre in the time slot allotted i.e. 15 minutes in the beginning and 15 minutes in the interval for showcasing the slide show of local advertisement and other detail as directed by the First Party on demand to be decided by the Cinering Application as per booking and revert points used by the customer and redeemed by the local shopkeepers.
All the functioning will be managed by a software system Called Cinering and the services charges shall be deducted from the Ticket Price.
Once the application is downloaded should not be deleted before redeem of point or booking ticket and watching movie, incase if it gets deleted you cannot enroll again and get back points, enrolment and redeem of points will depend upon the status and reason behind also the application status with no assurance of any kind
Registration will be made on entering contact detail as to phone, email id which will be used for further communications
Login page will be assessable of filling details and password sometimes along with dual verification by an OTP on the phone for safety reasons
On login you can get access to ticket booking platform where you can see availability of tickets for your favourite movies on viewing you can decide your slot and book ticket
Once you book ticket as per availability you will have to make payment for the same via payment gateway
On payment you will get points in your accounts with various options of list of shops in your locality and their offer sheet from where you can select and book and avail offer for the same day or any other date as per the validity date mentioned in the offer sheet
In case you want to book ticket for future date then you can do the same by making payment in advance for the slot available on the application
You will get digital ticket which will be just like the manual ticket which can be viewed on your phone on verified by the ticket checker or Cinering staff you will be allowed to watch the movie. This is to ensure that your ticket does not get misplaced and you get the personal benefits
Along with ticket you will get a coupon for eatery which will be free of cost and you will be served with any snacks and cold drink in the interval.
This facility will be available for any adult above age of 18 years.
Many tickets can be booked at the same time via wallet or payment gateway according to options available
Many tickets will give you points which can be redeemed as per the sheets available on the platform of the application.
In case of misplace or damage to the equipments you can login again and redeem your points by OTP on your phone number depending upon the application status.
Shopkeeper will have to be told about offer before purchasing the product and on acceptance by the shopkeeper the customer should purchase the product.
Shopkeeper will be bound to redeem the points as per the offer sheets incase if he refuses or due to certain unexpected situation or differences does not issue to the customer in that case the customer can raise a query for which immediate other better option will be made available to the customer.
In no case money will be refunded to the customer instead additional points and better option will be made available depending upon the situation.
Customer also has another option he can go online and book ticket by providing few additional details as to his favourite hero, movie he likes to watch and other basic questions and book ticket with a validity of six month time period from the date of booking.
Customer can book ticket by disclosing his likes for future date and avail points which can be redeem in six months time.
In case of registered vendors who are displayed on the platform customer can purchase and get free tickets from them as a discount in return for the purchase made by them.
This ticket can be availed directly on the listed Theater by the customer and can watch movie on the date and time displayed on the ticket
In case if the customer failed to come to the theater on the date mentioned he cannot claim the benefits latter
The issuance of the ticket will be permitted only if the customer install Cinering Application and is a registered member mentioned in the list.
Customer can collect the points into his account from the vendor application site on purchase from registered vendors in a particular locality and then book ticket for movie of his choice according to availability in cinema located in the same locality.
Customer will be eligible to all the benefits only if he has Cinering while availing benefits. In no case will he be allowed on future assurance.
Cinering application will be available on play store for android users and also on apple play store for I phone users
Any sort of grievances should be registered with our customer care number or email to our mail id grievances. support@cineering.com
Our Grievances Resolving team will try to resolve the issue as soon as possible and in the best convenient way.
Customer will have to accept the final decision made by the company and have to come to a solution with mutual understanding.
The Customer will be provided PAN India services and this application can be used for booking tickets anywhere in India however to avail the benefit have to share OTP number received on the registered mobile number.
The local rules and regulation should and will be followed while availing benefits on the application.
Services will be reserved for the application and its functioning fully automatically by command programming.
Customer can exit any time by deactivating the application and no binding of any kind will be on the user.
